In order to further regulate the charitable fundraising activities conducted by charitable organizations and the Red Cross in support of epidemic prevention and control in accordance with the law, the following guidelines have been issued by the Ministry of Civil Affairs:
I. Charitable organizations and the Red Cross shall strictly abide by the Charity Law of the People’s Republic of China, the Law of the People’s Republic of China on the Red Cross, the Law of the People’s Republic of China on Donations to Public Welfare, and the Law of the People’s Republic of China on Emergency Response Laws and regulations to regulate fundraising and other activities in accordance with the law.
2. Charitable organizations and the Red Cross, if they have obtained public fundraising qualifications according to the law, may carry out fundraising activities aimed at the public. In carrying out fundraising activities, the principle of voluntariness must be adhered to.
3. Charitable organizations and the Red Cross shall submit a fundraising plan to the civil affairs department for record ten days before the public fundraising activities are carried out. If the situation is urgent and the fundraising program cannot be filed before the public fundraising activities are carried out, the record-filing procedures shall be re-submitted within ten days after the start of the public fundraising activities.
4. Where charitable organizations and the Red Cross carry out public fundraising activities through the Internet, they shall publish public fundraising information on the Internet public fundraising information platform designated by the Ministry of Civil Affairs.
5. Charitable organizations and the Red Cross should act in accordance with the epidemic prevention and control, and under the unified leadership and deployment of the joint prevention and control mechanisms in various places, according to the actual needs of epidemic prevention and control, fully respect and reflect the wishes of the donors, reasonably distribute and use donations.
6. Charitable organizations and the Red Cross must speed up the work pace and effectively dock with receiving units such as epidemic prevention and control designated diagnosis and treatment hospitals, and send donated money and materials to the front line of epidemic prevention and control as soon as possible to prevent the overstock of donated money and materials.
7. The targeted donated materials received by charitable organizations and the Red Cross shall be entrusted to the donors or delivered directly to the end-users by the donors.
8. Charitable organizations and the Red Cross should do a good job in data collection and information disclosure of donations and materials, and promptly announce the receipt and distribution of donations and materials to the society, especially the details of the receipt and distribution of key epidemic prevention and control materials.
9. Charitable organizations and the Red Cross shall adopt methods such as reviewing donation agreements and checking related certificates to strictly control the donated medicines, medical equipment and other materials to ensure that the sources are legal, and distribution is consistent with standards, safe, effective and accurate.
